1. Introduction

1.1. These Terms and Conditions ("Agreement") govern your access and use of Creatorry, an AI-powered music generation platform operated by AYRAN DİGİTAL YAZILIM PAZARLAMA VE GELİŞTİRME LİMİTED ŞİRKETİ ("Company", "Ayran Digital", "we", "our", "us").

1.2. By accessing or using Creatorry.com, its app, or API (the "Service"), you ("User", "you") agree to be legally bound by these Terms in full. If you do not agree, you must not use the Service.

1.3. MANDATORY ARBITRATION: Disputes are subject to arbitration—see Section 12.

2. Eligibility

2.1. You must be at least 18 years old to use Creatorry. Use by minors is strictly prohibited.

2.2. You are responsible for maintaining the security of your account and activities conducted under it.

3. Use of Service

3.1. Subject to this Agreement and timely payment, the User may access the Service to generate music, lyrics, and other related digital content. By default, such content is provided for personal, non-commercial use, unless otherwise expressly provided in this Agreement.

3.2. The right to commercially use, distribute, publish, monetize, or otherwise exploit generated content for business purposes is granted exclusively to Users who hold an active PRO subscription (PRO status) at the time the respective content is created.

3.3. Users without an active PRO subscription may not commercially use, distribute, or sublicense generated content without obtaining a separate written license from the Company.

4. Account, Payments & Subscriptions

4.1. To use paid features, you must register and provide valid payment information.

4.2. All pricing is displayed at the time of purchase, inclusive of applicable taxes where required.

4.3. Subscriptions renew automatically at the current rates unless cancelled at least 48 hours before renewal.

4.4. Cancelling or deleting your account does not entitle you to a refund.

5. No Right of Withdrawal / Cancellation

5.1. By purchasing and using digital content generated by Creatorry, you waive any statutory right to withdraw, cancel, or request a refund due to the immediate and personalized nature of content generation.

6. User Content & Conduct

6.1. You are solely responsible for prompts, inputs, and other User Content submitted via the Service.

6.2. The User agrees not to use the Service for:

• Creating, publishing, or distributing unlawful, defamatory, abusive, hateful, discriminatory, obscene, or otherwise legally prohibited content;
• Attempting to decompile, reverse engineer, copy, extract the source code, models, algorithms, or other technology underlying the Service;
• Distributing, selling, sublicensing, or otherwise commercially exploiting generated works without an active PRO subscription or without obtaining a separate written license from the Company.

6.3. We may suspend or terminate your account for violations at our sole discretion. No refunds will be provided for terminated accounts.

7. Intellectual Property

7.1. The Creatorry platform, algorithms, and code remain the sole property of Ayran Digital

7.2. You are granted a limited, non-exclusive, non-transferable right to use the generated music for personal purposes, unless explicit commercial rights are granted.

7.3. By submitting input (including prompts, feedback, or other materials), you grant Ayran Digital a worldwide, royalty-free license to use it for service improvement and compliance purposes.

8. Service Availability

8.1. Creatorry aims to maintain uninterrupted service but does not guarantee full-time availability. We are not liable for any interruptions or data loss.

9. Disclaimer & Limitation of Liability

9.1. THE SERVICE IS PROVIDED "AS IS" WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED.

9.2. Our maximum liability to any user shall not exceed the amount paid by you in the 12 months preceding a claim, up to $100 USD.

10. Modifications

10.1. We may amend these Terms at any time. Changes take effect upon posting to the Website. Continued use of the Service after changes constitutes acceptance.

11. Communications

11.1. By using Creatorry, you consent to receive service, legal, and administrative notices via email and/or in-app notifications.

12. Governing Law & Arbitration

12.1. This Agreement is governed by the laws of Republic of Türkiye.

12.2. All claims and disputes shall be resolved exclusively by binding, individual arbitration. Class actions are not permitted.

12.3. To opt out of binding arbitration, you must notify us in writing within 30 days of acceptance.

13. Termination

13.1. We reserve the right to terminate your account or access to the Service at any time, with or without cause. No refunds will be owed in such cases.
